10.1 Your rights
Subject to the conditions, limitations and exceptions under Applicable Law, you have the right to:
(a) request the correction of inaccurate Personal Data or the completion of incomplete Personal Data that we hold about you;
(b) request the erasure of your Personal Data where, for example, it is no longer necessary for the purposes for which it was collected or processed, you withdraw your consent where the processing is based on your consent, you object to the processing and there are no legitimate reasons for us to continue processing, or the processing is otherwise carried out in breach of Applicable Law. Please note that this right is subject to certain legal exceptions, including where erasure would affect investigations, legal proceedings or rights, or where we are otherwise required or permitted by Applicable Law to retain your Personal Data;
(c) request that we restrict our processing of your Personal Data where, for example, you contest the accuracy of your Personal Data while we verify it, you object to processing that is inconsistent with the agreed purposes, or the processing is carried out in breach of Applicable Law;
(d) object to our processing of your Personal Data where permitted by Applicable Law, including where the processing is carried out for direct marketing purposes (including related profiling), for statistical surveys (unless necessary to serve the public interest), or otherwise in breach of Applicable Law;
(e) receive the Personal Data you have provided to us in a structured and machine-readable format and, where technically feasible, request that such Personal Data be transferred to another controller, where the processing is based on your consent or is necessary for the performance of a contract with you and is carried out by automated means;
(f) obtain information about our processing of your Personal Data, including the categories of Personal Data we process, the purposes of processing, any automated processing or profiling, the categories of recipients with whom your Personal Data is shared inside and outside the UAE, and our retention periods;
(g) object to decisions based on automated processing, including profiling, where such decisions have legal effects on you or otherwise adversely affect you, unless the automated processing is permitted under Applicable Law, and request that such decisions be reviewed by a human where required by Applicable Law; and
(h) lodge a complaint with the competent supervisory authority if you believe our processing of your Personal Data does not comply with Applicable Law.
We will respond to requests made under this clause within the timeframe required by Applicable Law. Before responding to your request, we may take reasonable steps to verify your identity and may refuse a request where permitted by Applicable Law.
10.2 Your choices
You may:
(a) deactivate your Account by emailing us at support@ziina.com.
(b) cease our collection of location information at any time via the settings on the Platform. In order to provide certain Services, we may need to access to your location information, including precise geolocation information collected from your device. If you disable location access, certain Services or features may not function properly.
(c) opt out of receiving push notifications containing certain information from us by disabling "Notifications on Promotions" and/or "Notifications on Transactions" under the notification settings on the Platform or by following the instructions in those notifications, if applicable. If you decide to opt out, we may still send you non-promotional communications via in-app or push notifications or via email and SMS, such as messages about your Account, actions required to complete a transaction or requests to update your information.
The Personal Data we collect from you may be transferred to, and stored or processed in, a destination outside the UAE, including by our affiliates and group companies or by service providers located outside the UAE. Such transfers may also occur where necessary to support our business continuity and disaster recovery arrangements to ensure the continuity and resilience of our Services. Where we make such a transfer, we take reasonable steps to ensure your Personal Data receives a level of protection consistent with that required under Applicable Law, including, as applicable, by transferring to jurisdictions recognised as providing an adequate level of protection, entering into appropriate contractual safeguards with the recipient, or relying on another transfer mechanism permitted under Applicable Law. Where your explicit consent to a specific transfer is required under Applicable Law, we will obtain it before making that transfer.
We will only retain your Personal Data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, accounting, or reporting requirements.
To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements.
In some circumstances, we may anonymize your Personal Data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
Our Platform is not generally intended for minors, except where we expressly offer products or Services to minors in accordance with Applicable Law. Where we offer such products or Services, we may collect and process the Personal Data of minors, in accordance with Applicable Law, as necessary to provide those products or Services.
Where required by Applicable Law, we will obtain the necessary consent or authorisation from a parent, legal guardian or other authorised representative before collecting or processing the Personal Data of a minor. If we become aware that we have collected Personal Data from a minor in circumstances not permitted by this Privacy Policy or Applicable Law, we will promptly delete it unless we are legally required or permitted to retain it. If you believe that we have collected Personal Data from a minor in such circumstances, please contact us at support@ziina.com.
